Lifeonmedia will treat its customers as we would like to be treated ourselves. Please note that your statutory rights under current EU consumer protection laws are not affected by anything in these terms and conditions.

Application

By supplying content to Lifeonmedia for use in an online video, a customer or website owner or manager is agreeing to the content of these Terms and Conditions.

Service Supply

We make every reasonable effort to supply you with the services described in our webpages, in our brochures or in our agreements with you within agreed time frames. We will NOT print, record or publish anything which we consider to be libellous or which we consider might defame third party individuals, companies, organisations or institutions.

The standard process in terms of delivery of our online video services is that we will require that you deliver the content (News items, Press Releases, video clips, pics, etc) to us by a predefined date. We require video clips, pics, etc of a sufficient quality to ensure that they are compatible with the overall quality of your video production. Please keep a copy of all material that you supply to us as, unfortunately, we cannot guarantee that such content will be retained by us after use or returned to you.

Using the material that you provide to us, our skilled editors prepare the “story board” and script for your video. (A story board indicates the main editing features that are used in the production of the video - images, video inserts, etc.) The script and story board are forwarded to you for approval. In order for us to be ready for your recording, we require your approval of the script and story board by the due date. Please note that when you approve these, the editor’s decision is final and no change will be made to the program we send to you unless you undertake to pay for a new edit and recording, if necessary.

We undertake to record your online video for you and deliver this program to you via the Internet. Our standard practice is to host your video on our streaming server and stream your video to your website. This allows a very large number of simultaneous views of your video, keeps the demand for “bandwidth” on your own website to an absolute minimum and reduces the requirement for involvement of your Webmaster. We will give you a short piece of computer “code”(”Embed Code”) when your first video piece is ready to go live. You will need to have your Webmaster insert this code into the Home Page of your website. When this code is in place, your video piece will stream into your website every time it is viewed. There is no need to have this code put into your website a second time - whenever an updated video piece is ready for you it will stream to your Home Page without any need for your Webmaster to be involved!

Test. Before going “live” (with your first online video) you can have your Webmaster test how the streaming video will “look and feel” on your Home Page by testing a Sample video on a Test Page on your website - see “Size of Video Player” below.(We recommend that your Webmaster copy the code for your Home Page on to a Private Page on your site.) Just ask your Webmaster to email us at info@lifeonmedia.com and we will send on the sample Embed Code.

Size of Video Player. Unless otherwise agreed in writing in advance, we stream the online video to your website in a video player that is 300 pixels Wide and 220 pixels High. (The actual video itself is 300 x 180.) We reserve the right to cease the streaming of an online video to a player in which the viewing area has been reduced by or on behalf of the website owner.

Location of Video Player (on Website). Unless otherwise agreed by us in writing in advance, the Lifeonmedia online video player is to be set up on the website’s Home Page. The Lifeonmedia player must normally be visible when the Home Page is opened on a computer, i.e. without requiring the viewer to scroll down the Home Page.

It is your responsibility to ensure that you post the Embed Code on your website, WE WILL NOT do it for you.

Inform Members of Online Video on Website. Where an online video has been sponsored by a third party, the owner or manager of the website hosting the piece agrees to inform the members of the organisation or users of the website (where possible) each time a new or updated video piece is placed on their website. (This would normally be done by Newsletter or eZine, etc.)

WE WILL NOT export this program to your iPod or other mobile or video display device (like a TV for instance) but WE WILL give you advice on how to do so. In fairness, it is in our interest to ensure that you get this done so we will do all we can to help you in this regard, but sometimes the quickest and simplest thing may be for you to avail of the services of a Webmaster or IT expert.

Updated Videos. Where a series of videos is supplied (normally a News piece that is updated regularly), each “new” piece for you will be “pushed” to your website when available (using our Streaming Video feature). This will remove the previous piece from the website and from all locations that may have been populated by the viral distribution features of Lifeonmedia videos. We cannot guarantee that “old” versions of your videos will be maintained after an updated piece has been streamed to your website.

If you have a requirement for a service from us within a very short time frame, it would be best to engage with us as soon as possible. Naturally, special projects will have special pricing and this will be agreed with you in advance.

Our Packages

If you buy a package of TV News programs online from Lifeonmedia it is your responsibility to ensure that you use the entire package and provide us with the necessary material to allow us to keep our side of the bargain.

We undertake to keep you informed of the number of programs left in your package but we will not refund a fee for an unused or partially-used package. It is your responsibility to provide press releases/text, still and video images in order for Lifeonmedia to deliver such a service to you. In the case of press releases/text and still digital images, these can be uploaded via our website.

We require that video be supplied to us on DVD and not be more than five minutes’ duration and sent to us by courier and the tracking information be supplied via our website.

Guarantee / Complaints

If you are not happy with the service we provide please contact us immediately. If you have a complaint, we are happy to discuss it with you and resolve it sensibly and fairly. We don’t want unhappy customers and guarantee that we will not try to use the anonymity of the web to escape from our responsibilities.

If a customer is unhappy we are willing to engage with that customer by telephone or personal visit, whichever is required.

Payment / Credit Policy

Unless otherwise agreed as part of a signed contract, payment shall be made as follows:

a.  50% to be paid two weeks before the date of recording of the video for the customer,

and

b.  balance within 30 days of the Embed Code for the Customer’s video piece being sent by email to the Customer or, in a case where the video is “pushed” to the internet by Lifeonmedia, of the video going “live” on the Customer’s website.

In the event of an issue regarding payment for our services, Lifeonmedia reserves the right to cease the streaming service to the customer. This will cease the streaming not just to the customer’s website but also to “locations” where the video(s) concerned are available either by means of distributed links or embedded code.

Online Customers - Lifeonmedia Packages

Normally our internet customers will pay us through the internationally recognised PayPalTM system. This is a secure electronic payment system used on thousands of websites worldwide. If you wish to pay by cheque we will wait until your cheque has cleared before we provide our service.

 

Charges for Streaming Video Service

The cost of streaming an online video to a website is included in Lifeonmedia’s charges to the customer or the sponsor of an online video. However, Lifeonmedia undertakes this cost based on the understanding of the average traffic to the website concerned and, although the web traffic will be expected to grow considerably when the online video is marketed fully, we reserve the right to request a contribution from the customer or sponsor should the cost of the streaming of a particular video increase inordinately.

Where an online video is a “once off” piece for a customer (i.e. not routinely updated), the cost of streaming the video for twelve months is included in Lifeonmedia’s charges. Thereafter, the charge for the streaming of the inline video piece will be negotiated.

VAT

Our office is located in Galway, Ireland. Value Added Tax at the rate of 21.5% will be payable within the EU on our services. VAT will not apply to the provision of this service outside the EU.

Final Note

We are delivering our service through the internet. Although a powerful medium, it is also imperfect and there may be issues like download speed, delays and hosting problems. We will work with you to fix any such problems quickly.
